How to become a guardian?
Ok so my sister a no good mother, she has a 5 years old a 3 years old and a 2 month old baby girl, they all live with me and my husband for the passed 1 year and half. I can not take her anymore she does not care about the kids or anything so we are sending her back to Brazil. Now we own a house we make good money pay all our taxes, but we're here illegally can we still become their guardian.If yes what do they want to know about us (both of us have a clean record) what will they ask.

If you are in this country illegally, I don't believe that you can apply for guardianship in the US. You might want to check on guardianship in your own country first, then apply for citizenship here. Once you are a citizen of the US, it is a lengthy, pain-in-the-butt process to get guardianship. You will need a notarized statement from your sister, get the state involved that you are living in, they will assess you for appropriate guardianship, etc.

In most cases, unless there is opposition or state law requires an investigation into the family to serve as guardian, no one will ask about your citizenship. If your sister agrees to the guardianship, even less likely. However, you run the risk that your sister can threaten you with revealing your illegal status, and extort money or other things from you in return for her silence. You should consult a local lawyer familiar with guardianship and with immigration law (not a common combination, but in your state it might be). You will have to file a petition or complaint for guardianship in the appropriate court (probate or family law court, usually, but it depends on your state's laws and rules).

Hey, What country are you living in? I think in any country you need to be a citizen but that may vary depending on the country you live in.If you or your husband has no criminal record there should be no problem, you will have to contact the social welfare office near your location and explain your situation to them. I am saying this on my own experiences. Thanks
